Terms of Service

These Terms govern your use of Point — the desktop assistant that reads and acts on what you point at with your cursor — together with our website, accounts, the optional Point Mouse, and related services (the “Service”). Point is operated by DesignCheck (“we”, “us”), Netherlands. By creating an account or using the Service you agree to these Terms.

Point is in active development. Features, plans and these Terms may change; we'll post material changes here and, where required, notify you by email.

1The Service

Point runs on your computer and can read the element under your cursor (via the operating system's accessibility APIs and, where needed, on-screen capture), explain it, save it to your lists and memory, and perform actions you request. Point is model-neutral: it connects to AI providers you choose — including local open-source models — and, optionally, to a physical “AI mouse” we may supply.

3Plans, billing & renewals

Prices are shown in euros and include applicable VAT unless stated. Payments are processed by our provider, Mollie; we don't store your full card details.

4Right of withdrawal & refunds

For consumers in the EU: for digital subscriptions you have a 14-day right of withdrawal, which you may waive to obtain immediate access. Hardware may be returned within 14 days of delivery in resaleable condition. To exercise these rights, contact hello@designcheck.nl.

5Your AI keys & third-party providers

When you connect a provider (Anthropic, OpenAI, Google, Higgsfield) or run a local model (Ollama), your use is subject to that provider's terms, and content you point at may be sent to the provider you selected for that action. You are responsible for your own API keys and any usage charges they incur. In local mode, content stays on your machine.

7Actions & your responsibility

Point can perform actions on your behalf. Anything outward or irreversible (sending, posting, paying, deleting) requires your explicit confirmation. You remain responsible for actions you approve. Point is a tool, not a person; review what it proposes before you confirm.

8Intellectual property

Point, its software, brand and content are owned by DesignCheck and protected by law. We grant you a limited, personal, non-transferable licence to use the Service under these Terms. You keep ownership of your own content.

9Beta & “as is”

The Service is provided “as is” and “as available” during the beta, without warranties of any kind to the extent permitted by law. AI outputs can be wrong — don't rely on them for critical decisions without checking.

10Liability

Nothing in these Terms limits liability that cannot be limited by law (including your mandatory consumer rights). Otherwise, to the extent permitted by law, DesignCheck is not liable for indirect or consequential loss, and our total liability is limited to the amount you paid us in the 12 months before the claim.

11Termination

You can stop using Point and delete your account at any time. We may suspend or end access if you breach these Terms or to protect the Service. On termination, licences end; sections that by nature survive (IP, liability, governing law) continue.

12Governing law

These Terms are governed by the laws of the Netherlands, without prejudice to mandatory consumer protections in your country of residence. Disputes are subject to the competent courts of the Netherlands.
